Who This Notice Covers
This Notice is adopted by the network of independent, physician-owned medical practices that deliver clinical care through the Averion Health LLC telehealth platform. Each affiliated practice is a HIPAA-covered entity. Averion Health LLC provides non-clinical technology and operational services as a Business Associate under written BAAs.
How PHI May Be Used Without Your Authorization
For Treatment — PHI is used to provide, coordinate, and manage your healthcare, including sharing with dispensing pharmacies and lab vendors. For Payment — PHI is used to bill and collect payment for services. For Healthcare Operations — PHI is used for quality assessment, compliance audits, and business planning. As Required by Law — PHI will be disclosed when required by federal, state, or local law.
Uses Requiring Written Authorization
The following uses require your written authorization, which you may revoke at any time: (1) use or disclosure of psychotherapy notes; (2) use of PHI for marketing purposes; (3) sale of PHI; (4) other uses not described in this Notice.
No Tracking Technologies on PHI Pages
Consistent with the December 2022 HHS OCR bulletin on tracking technologies, no third-party advertising trackers are deployed on any page where you submit health information, complete the patient application, or interact with patient portal content.
Your Individual Rights
Right to Access — inspect and obtain a copy of your PHI within 30 days. Right to Amend — request amendment of PHI you believe is inaccurate. Right to an Accounting of Disclosures — request a list of certain disclosures made in the prior six years. Right to Request Restrictions — request restrictions on how PHI is used. Right to Confidential Communications — request communications in a specific way or location. Right to be Notified of a Breach — receive notification following a breach of unsecured PHI.
Complaints
If you believe your privacy rights have been violated, you may file a written complaint with your affiliated practice's Privacy Officer or with the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be retaliated against for filing a complaint.
